1. PREAMBLE

These Terms and Conditions of Sale (hereinafter “T&Cs”) apply to all purchases made through the website borisbrucher.com (hereinafter the “Website”).

By placing an order on the Website, the customer (hereinafter the “Customer”) fully agrees to these T&Cs.

The T&Cs may be updated at any time. The applicable version is the one accepted at the time of the order.

2. ABOUT

The Website is operated by Boris Brucher, artist and independent creator, based in France.

3. PRODUCTS

The Website offers original artworks and objects (drawings, ceramics, furniture, etc.).

Each piece is:

  • unique or produced in limited quantities
  • handmade

Minor variations, irregularities, or imperfections are part of the artistic process and are not considered defects.

Product descriptions and images are provided as accurately as possible. However, slight differences in color or appearance may occur.

4. PRICES

Prices are displayed in EUR (€) and may also be shown in other currencies for convenience.

  • Prices include VAT when applicable
  • Shipping costs are not included and are calculated at checkout

For international orders:

  • customs duties and taxes may apply
  • these are the responsibility of the Customer

5. ORDER

The Customer selects products and adds them to the cart.

Before confirming the order, the Customer can review and modify their selection.

Once payment is confirmed:

  • the order is final
  • a confirmation email is sent

The seller reserves the right to cancel or refuse any order in case of dispute or suspected fraud.

6. PAYMENT

Payment is made securely via:

  • credit/debit card
  • or other payment methods available on the Website (e.g. PayPal, Apple Pay)

All transactions are processed through secure payment providers.

7. DELIVERY

Orders are shipped from France.

Estimated delivery times:

  • France: 3–5 days
  • Europe: 3–7 days
  • International: 5–10 days

Delays may occur due to customs or carrier issues.

The Customer is responsible for providing accurate delivery information.

8. SHIPPING COSTS

Shipping costs are calculated at checkout.

For certain items (large or fragile pieces), additional shipping fees may apply.

9. CUSTOMS & TAXES

For deliveries outside the European Union:

  • customs duties
  • import taxes

may be charged upon delivery.

These costs are the responsibility of the Customer.

10. RIGHT OF WITHDRAWAL (RETURNS)

The Customer has the right to return a product within 14 days of delivery.

Conditions:

  • the item must be unused
  • returned in original packaging
  • in its original condition

Return shipping costs are borne by the Customer.

11. REFUNDS

Refunds are issued after inspection of the returned item.

  • refunded via original payment method
  • within 14 days after receipt

Shipping costs are not refunded.

12. DAMAGES / ISSUES

If an item arrives damaged:

  • the Customer must contact within 48 hours
  • provide photos of the damage

A solution will be offered (refund or replacement when possible).

13. LIABILITY

The seller cannot be held responsible for:

  • delays caused by carriers
  • customs delays
  • force majeure events

14. INTELLECTUAL PROPERTY

All artworks, images, and content on the Website are the exclusive property of Boris Brucher.

Any reproduction or use without permission is strictly prohibited.

15. APPLICABLE LAW

These T&Cs are governed by French law.

In case of dispute, an amicable solution will be sought before any legal action.
